The short versionBe a good citizen. Send the email people asked for. Don't send malware, phishing, or unsolicited bulk mail. Pay your bill. We'll keep your data secure and your API up. Either of us can leave with notice.

The agreement

These Terms of Service (the "Terms") govern your access to and use of the LayerSend platform, APIs, dashboards, SDKs, documentation, and any related services (collectively, the "Service") operated by LayerSend, Inc. ("LayerSend," "we," "us").

By creating a LayerSend account, calling the API with an issued key, or otherwise using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to the Terms.

Your account

You need a workspace to send email. You're responsible for the security of your API keys and login credentials, and for all activity that happens under them.

  • You must be at least 18 years old, or the age of majority in your jurisdiction.
  • One human, one account. Workspaces may have multiple members; accounts may not be shared.
  • Keys are credentials. Treat Authorization: Bearer ls_… like a password — never check it into source control, never paste it in a support ticket.
  • Notify us promptly at security@layersend.com if you suspect unauthorized access.

Acceptable use

You agree not to use the Service to send any message that:

  • Violates applicable law, including CAN-SPAM (US), CASL (Canada), GDPR / ePrivacy (EU/UK), or comparable regulations in your jurisdiction.
  • Contains malware, phishing payloads, or attempts to deceive a recipient about the identity of the sender.
  • Promotes illegal goods or services, child sexual abuse material, content inciting violence, or content infringing third-party intellectual property.
  • Is sent to recipients who have not provided consent, or who have unsubscribed, or whose addresses were harvested without permission.

We may suspend a workspace immediately if we reasonably believe a violation has occurred, particularly where continued sending would damage the deliverability of shared infrastructure.

Sending rules

Identity

Every email you send through LayerSend must include a working From: address you control, a physical mailing address (where required by law), and — for marketing mail — a one-click unsubscribe mechanism honored within ten (10) days.

Domain verification

Sending domains must pass DKIM, SPF, and DMARC verification within the LayerSend dashboard. Sends from unverified domains are subject to rate limits and reduced deliverability.

Suppression

The Service maintains a suppression list of hard-bounced and complaining recipients. You agree not to attempt to bypass suppression, including by rotating subdomains or re-encoding addresses.

Fees & billing

The Free plan includes up to 3,000 emails per month per workspace. Paid plans are billed monthly or annually in advance, in U.S. dollars, via the payment method on file.

  • Usage above plan limits is billed at the overage rate listed on your billing page, prorated to the nearest unit.
  • Refunds are not provided for partial billing periods, except where required by law.
  • Taxes are your responsibility unless we are required to collect them in your jurisdiction.
  • Late payment. Accounts more than thirty (30) days past due may be suspended; we'll always email you first.

Customer data

You own the email content, recipient lists, templates, and configuration you upload to the Service (your "Customer Data"). You grant LayerSend a limited license to process Customer Data solely to operate and improve the Service for you.

We process Customer Data in accordance with our Privacy Policy and our Data Processing Addendum (available on request). Sub-processors include Amazon Web Services (email delivery infrastructure), Supabase (database hosting), and Railway (application hosting).

RetentionEmail message bodies are retained for thirty (30) days for log inspection, then purged. Event metadata (delivered, opened, bounced) is retained for the lifetime of your workspace. You may delete records at any time from the dashboard.

Intellectual property

The LayerSend name, marks, dashboard, API, and documentation are owned by LayerSend, Inc. We grant you a non-exclusive, non-transferable license to use the Service for its intended purpose, subject to these Terms. You may not reverse-engineer, resell, or sublicense the Service without written permission.

Warranties

We provide the Service "as is" and disclaim all warranties to the maximum extent permitted by law — including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

That said: we work hard to keep the Service reliable. Our public Status page reflects current incidents. Enterprise plans may include a separate Service Level Agreement with uptime credits.

Limitation of liability

To the maximum extent permitted by law, LayerSend's total aggregate liability arising out of or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. Neither party shall be liable for indirect, incidental, consequential, special, or punitive damages.

Term & termination

You may cancel your subscription at any time from the dashboard. We may terminate or suspend the Service:

  • For material breach of these Terms, including the Acceptable Use section.
  • For non-payment after notice.
  • If continuing to provide the Service would expose us to legal or regulatory risk.

On termination, your data will be available for export for thirty (30) days, after which it is permanently deleted from production systems.

Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in San Francisco County, California.

Changes to these Terms

We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top, and — for material changes — email all workspace admins at least fourteen (14) days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance.
